It cannot reflect the imaging ordered afterward, the physical therapy authorization still pending, the shifts a supervisor covered, or the help someone gave you at home for three weeks. Before responding, list what the file is missing rather than arguing about the number. A demand that supplies documents the other side has never seen is a different conversation than a demand that repeats a complaint.
Chronology persuades where adjectives do not. Put the ambulance run first, then the emergency record, then every visit, referral, prescription and restriction in the order it happened, each with a date and a source. Civil Code section 3040 limits a health plan or medical group reimbursement lien to the reasonable costs of perfecting it plus the amount actually paid to treating providers. Where services were delivered on a capitated basis, the measure is 80 percent of the usual and customary charge in the geographic region where the care was given. If the enrollee engaged an attorney, the lien may not exceed one-third of the moneys due under any final judgment, compromise or settlement agreement. Hospital liens, public program recovery and workers' compensation reimbursement each run under different statutes, so one-third is not a general rule. Total the reductions before agreeing to a figure, or the number that sounded acceptable becomes a much smaller check.
A release is the only irreversible document in the process. Read who it releases, what claims it closes, and whether it reaches parties nobody has investigated yet, such as a vehicle owner, an employer or a broker. Insurance Code section 11580.2 removes uninsured and underinsured coverage where the insured settles with or prosecutes to judgment an action against a person who may be legally liable without the insurer's written consent. If your own endorsement might still matter, that consent has to be requested and received in writing before the third party's check is endorsed.
Local rules place civil proceedings in the Monterey Division, and the civil division sits at the Monterey Courthouse at 1200 Aguajito Road, with public hours on weekdays from 8:00am to 4:00pm. Documents in non-mandatory electronic filing cases may be delivered at the Salinas, Marina or Monterey locations and are date-stamped when received before being routed. Uninsured motorist claims carry their own trigger, since no cause of action accrues unless within two years of the accident suit is filed against the uninsured motorist, the amount due is agreed, or arbitration is formally instituted through written notice mailed certified, with a return receipt requested. Negotiation does not pause any of them, and an adjuster is not obliged to remind you.
A serious injury here generates paper in at least four places: a field agency, an ambulance service, the trauma center, and whoever handles follow-up. Natividad Medical Center runs the county's Level II trauma center with ten intensive care beds, staffed all day and every day, and its coordinated care program is described as the only one of its kind in the tri-county area. Request the full record rather than a discharge summary, including imaging reports and the nursing notes, and check that the ambulance record exists separately. Gaps in the chronology are read as gaps in the injury.
Business and Professions Code section 6147 requires a contingency contract in writing, signed by both attorney and client, with a duplicate signed copy provided at the time it is entered into. It must state the rate, how disbursements and costs will affect both the fee and the client's recovery, and the extent of any compensation owed for related matters outside the contract. Unless the case falls under section 6146, it must also say the fee is open to negotiation rather than fixed by law. Fall short on any of those points and the client may void the agreement, which leaves the lawyer with a reasonable fee and nothing more.
