How wide the gap has actually grown

The Insurance Research Council reported that 15.4 percent of drivers nationwide were uninsured in 2023 and 18.0 percent were underinsured, meaning one of every three drivers was one or the other, a combined 33.4 percent that climbed about ten percentage points in six years. Forty-nine states and the District of Columbia require liability coverage, New Hampshire being the lone exception. Its offering limits sit at $30,000 for one injured person, rising to $60,000 where two or more are hurt. Vehicle Code section 16056 sets that floor at $30,000, $60,000 and $15,000 for property damage on policies issued or renewed on or after January 1, 2025. So the first document to read is your own declarations page, then any deletion or reduction form somebody had you sign years ago.

The unknown-driver rules, and why the county line matters

For a phantom or fleeing vehicle, the statute demands physical contact with the insured or with the automobile the insured occupies. The insured must also report the accident inside 24 hours, and the correct recipient depends on where the wheels stopped: municipal police at an address inside city limits, otherwise the county sheriff or the nearest Highway Patrol headquarters. Within 30 days the insured must file with the insurer a statement under oath setting out the facts of a cause of action against a driver whose identity cannot be ascertained. Geography decides which agency counts. Chualar, Spreckels, Spence Road and much of US 101 south of the airport lie outside city limits, so a crash ten minutes from downtown may owe its report to the sheriff rather than to city police.

Underinsured coverage is subtraction

An underinsured motor vehicle, by the statutory definition, is an insured one carrying less coverage than the uninsured motorist limits attached to the injured person's own car. Coverage does not apply until every applicable bodily injury liability limit has been exhausted by payment of judgments or settlements, with proof of that payment submitted. Maximum liability is then the underinsured limits less the amounts paid by or for anyone legally liable. The paying insurer is entitled to reimbursement or credit out of any recovery against the responsible party. If the insured sues the owner or operator of the underinsured vehicle, the statute says the insured shall forthwith give the carrier a copy of the complaint by personal service or certified mail, and shall make pleadings and depositions available.

The signature that can void the coverage

There is no coverage where the insured, without the insurer's written consent, makes any settlement with or prosecutes to judgment an action against any person who may be legally liable. That clause ends more claims here than any argument about fault. The safe order is fixed: identify every policy, notify your own carrier in writing, request consent in writing, then decide what to do about the third party's check. A release drafted by the liable driver's insurer will not mention your endorsement, and silence is not permission.

How the dispute gets decided

Disagreement over liability or amount goes to arbitration conducted by a single neutral arbitrator. Where the insured may have workers' compensation rights, arbitration is stayed until the physical condition is stationary and ratable, and any demand or petition must carry a declaration under penalty of perjury addressing that compensation claim. Civil discovery rules apply. No cause of action accrues unless, within two years of the accident date, suit is filed against the uninsured motorist, agreement as to the amount due is concluded, or the insured formally institutes arbitration by notifying the insurer in writing sent by certified mail with return receipt requested. Arbitration must then conclude within five years of institution, or within three years of the conclusion of a compensation claim, whichever is later.

The provision that can delete half the recovery

Civil Code section 3333.4 bars recovery of noneconomic losses, including pain and suffering, from three categories of injured people: someone convicted of driving under the influence in that crash, the owner of an uninsured vehicle involved in it, and an operator who cannot establish financial responsibility. Insurers are also barred from indemnifying those losses. One exception restores them where an uninsured owner was injured by a driver later convicted of a drunk-driving offense. Economic losses, meaning medical care and lost earnings, remain recoverable in every one of those situations.
